After being arrested and facing felony charges for a penetration test at the Iowa County Courthouse, Justin Wynn and Gary DeMercurio, now Gabby DeMercurio, sued the county and sheriff. The lawsuit, initially dismissed by the county, was eventually settled for $600,000, establishing a new precedent for penetration testing rights.
“So, eventually when the third-party investigation was complete, which said that the state had jurisdiction to hire Coalfire to run these tests and the state point-of-contacts all approved that Coalfire was hired to do it, all this came together and was given to the county prosecutor.”
“So, we ended up going through arbitration where they take a former judge and — goes back and forth and tries to settle the case. But at that time they were still being super, super, super stingy. They were like, oh, we’ll give them fifty.”
“So, they took it. The lawsuit was closed. They got paid. They won. This allowed them to celebrate.”
